This development (building next to Coles supermarket on south side) was first submitted in 2012, following objections the DA was withdrawn and resubmitted in 2013 (Ref DA No. N0088/13). The proposed development is for shop top housing and with what we believe is far too much housing development for the site. The proposal has immense negative impacts on the neighbours regarding light and views. The proposal does not meet the set-back requirements of the Newport Master Plan. The NRA received a letter from Pittwater Council dated 19/11/2013 advising the proposal had been refused. The applicants have subsequently applied to the Land & Environment Court and a conciliation hearing was conducted on site and at the council offices before Commissioner O’Neill on the 25th July 2014. The NRA was represented at the on-site meeting and made a submission to support the objections of the neighbours and reiterate its own objections re non-compliance. We await the conciliation hearing outcome.
The developer has now erected height poles so it would be good if members inspected the site and posted any comments below if they feel they can make a contribution or would like the NRA to make further submissions.
UPDATE 15/10/2014
The owner has put in a revised set of plans which maybe viewed under this DA application in the council’s DA tracking facility (DA N0088/13). The revised plans still do not meet the minimum requirements of the Newport Masterplan so we have put in a fresh objection which may be viewed under submissions.
UPDATE 8/12/2014
Pittwater Council and the developer have arrived at an agreement and their proposal went before a Land & Environment Court consent hearing on Monday 8/12/2104 at a site meeting followed by a meeting at the L & E court the same day. Pittwater council’s agreement does not comply with the setbacks in accordance with the Newport Masterplan so both Peter Middleton and Gavin Butler made representations to the court site hearing strongly objecting to any agreement that did not meet the setbacks of the Masterplan. We await the courts determination and will advise when we know.
